Learn about the procedure for obtaining a certificate

  1. Only those certificates may be issued that fall within the scope of competence of the Polish-Ukrainian Chamber of Commerce, specified in the Act on Chambers of Commerce of 30.05.1989 May 2009 (consolidated text Journal of Laws of 84, No. 710, item XNUMX, as amended) and the Statute of the Polish-Ukrainian Chamber of Commerce.
  2. Certificates will be issued on the basis of a written application by the entrepreneur (applicant) signed by authorized persons, submitted to the Certification Department of the Polish-Ukrainian Chamber of Commerce. The application and required documents can also be submitted electronically in the form of scans, with the requirement to submit originals upon receipt, under penalty of not issuing the certificate.
  3. In terms of its content, the application should specify, in particular, the requested content of the certificate, as well as indicate the person representing the applicant in the matter of the certificate and his or her contact telephone number.
  4. Where it is necessary to prepare a certificate, the application should contain a description of the factual circumstances and a presentation of other circumstances and data relevant to the content of the certificate.
  5. An application for issuing a certificate on the legal status of an economic entity should specify, first of all, the scope of the requested certificate (confirmation, separately or jointly, of the fact of registration of the entrepreneur, the subject of activity, rules of representation or other circumstances related to the entrepreneur's activity).
  6. An application for a certificate of the occurrence of circumstances that may constitute grounds for exemption from contractual liability should include, in particular, a detailed description of the circumstances causing non-performance or improper performance of the contract, the date and place of their occurrence, as well as the period of occurrence of these circumstances and their effects, information concerning the contract and its performance, in particular: date of conclusion, number, subject, contractor of the applicant, causal relationship between the described circumstance and the scope of non-performance or improper performance of the contract presented by the applicant, as well as other information necessary for issuing the certificate. These certificates may be issued at the request and in favour of the entity directly obliged under the contract to which they relate. Subject to exceptional situations, confirmed, in particular, by a similar certificate issued by the appropriate organisation from the country of the event, certificates may only concern circumstances that occurred in the territory of the Republic of Poland.
  7. An application for the issue of a certificate of legal succession and any other circumstances resulting in the transfer of rights and obligations should specify in detail the circumstances that the certificate is to confirm.
  8. The applications referred to in points 5, 6 and 7 must be accompanied by documents confirming the requested content of the certificate, which should be submitted in the original or in a photocopy certified to be true to the original by persons authorised to represent the applicant.
  9. If necessary, the applicant is asked to supplement the documents or provide explanations to the extent necessary to issue the requested certificate. Explanations and arrangements regarding the content of the certificate may also be made in working mode by phone or by electronic correspondence.
  10. Certificates are prepared in Polish or English, and in exceptional cases in other languages. The applicant is obliged to submit translations, in particular, of the subject of the activity or specialist texts that are to be included in the certificate. Regardless of the above, if necessary, the applicant may be charged for the costs of the translation of the foreign-language text of the certificate by translators.
  11. Certificates are prepared on the forms of the Polish-Ukrainian Chamber of Commerce. Both originals and copies of certificates are signed by authorized persons and stamped with the round seal of the Polish-Ukrainian Chamber of Commerce.
  12. Certificates are issued by the Certification Department of the Polish-Ukrainian Chamber of Commerce in person to the applicant or their authorized representative, upon receipt with the date filed on the copy of the certificate remaining in the files, or by post to the address indicated by the applicant. It is also possible to collect them by courier at the applicant's expense.
  13. The Polish-Ukrainian Chamber of Commerce has the right to refuse to draw up and/or issue a certificate in whole or in part if the conditions specified in this procedure are not met, if the requested content is not duly and reliably confirmed by attached documents or if it is considered that the requested circumstances cannot be confirmed by the Polish-Ukrainian Chamber of Commerce.
  14. After obtaining the certificate and paying the fee, the Polish-Ukrainian Chamber of Commerce issues an invoice for the issued certificate.

Certificate of the occurrence of circumstances that may constitute grounds for exemption from contractual liability

Certificates of the occurrence of circumstances constituting "force majeure" - constituting a basis for exemption from contractual liability - are issued by the Polish-Ukrainian Chamber of Commerce in strictly defined situations concerning economic turnover.

In order to obtain a certificate, it is necessary to submit an application by e-mail together with a detailed description of the specific factual situation to which the certificate is to refer. Scans of documents confirming the described circumstances, i.e. the agreement, annex, attachments, protocols, correspondence with customers and suppliers, etc. Correspondence should be sent to the e-mail address slawomir.szymusiak@pol-ukr.com.
