On July 29, this year, the Cabinet of Ministers of Ukraine adopted Order No. 665, finalizing the process of introducing the institution of an Authorized Economic Operator (AEO) in Ukraine, which, after meeting the conditions and criteria stipulated by law and obtaining the AEO certificate, as a reliable entrepreneur benefits from facilitations related to customs control regarding security and safety, as well as from simplifications provided for under customs legislation. Regulating the AEO institution was one of the requirements provided for in the Association Agreement between Ukraine and the EU.
The regulation in particular:
- Approves the AEO certificate application form.
- Approves the enterprise self-assessment survey.
- Regulates the rules for the customs authorities to assess whether an economic operator meets the conditions required to obtain an AEO certificate.
- Regulates the rules for confirming the qualifications of company employees responsible for customs matters.
- Establishes the values of the company's financial solvency and liquidity indicators (based on annual or half-yearly financial reporting).
- Approves the report form on the assessment of the company's fulfilment of the conditions necessary to obtain/maintain AEO status.
- Approves the decision form on granting/not granting AEO status to an entrepreneur.

Formal (initial) assessment of the application for issuing the AEO certificate should be carried out by the Customs Service of Ukraine within 30 days of submitting the application. Assessment of the entrepreneur's fulfillment of the conditions required for obtaining the AEO certificate should be carried out within 120 days.
